Independent public corporations
Independent public corporations are an artificial person, public in ownership, individually created by the state as a body politic and corporate for the administration of a public purpose relating to the state or its citizens. They serve a specific public purpose, are independent of governor’s direct supervisory control, may sue or be sued, and they exercise powers under authorizing statute and license or franchise. They are governed by a board of directors subject to recommendations and review by the Retirement and Independent Entities Committee, unless exempt, and are subject to audits, examinations, and reviews by the Legislative Auditor General. State laws that apply to state agencies are presumed not to apply to independent public corporations. ndependent public corporations are subject to the Open and Public Meetings Act (Title 52, Chapter 4), and GRAMA (Title 63G, Chapter 2). Other exemptions may be recommended by the Retirement and Independent Entities Committee or are provided for in the authorizing statute.
